The Immigration Reform and Control Act requires you to do the following.

  • Give the employee an opportunity to review the I-9 instructions.
  • Let the employee choose, from the list of acceptable documents, which documents they would like to provide as proof of identity and employment eligibility.
  • Review the original documents establishing identity and employment eligibility.
  • Properly complete Section 2 or 3 (if applicable) of the I-9 Form.
