Unacceptable Documents

  • An interim rule was published in the Federal Register on September 30,1997, that eliminates unacceptable documents on the back of the I-9 form.
  • The rule, which took effect immediately, affects only List A documents that establish both identity and employment eligibility.
  • The rule eliminates the following documents from List A.
    • #2 Certificate of US Citizenship (INS Form N-560 or N-561)
    • #3 Certificate of Naturalization (INS Form N-550 or N-570)
    • #8 Unexpired Reentry Permit (INS Form I-327)
    • #9 Unexpired Refugee Travel Document (INS Form I-571)
  • The US Citizenship and Immigration Services has not made public a revised I-9 form with these changes to List A. Employers should continue to use the existing I-9 form (11/21/91 version) under the interim rule. The rule makes no changes to List B and List C.
