Failure to abide by US Citizenship and Immigration Service (USCIS) and Department of Labor (DOL) regulations can result in penalties and liabilities to NC State University. These can include

  • Debarment from hiring employees into H-1B positions, if NC State is not in compliance with public access file, which may also result in fines ($1,000 - $35,000 per violation). If the employer has not paid appropriate wages, it may be ordered to pay back pay.
  • Civil penalties for each offense of employing unauthorized workers can be between $2,200 and $11,000 for each unauthorized worker
    • Subject to "paperwork violations" for failure to fill out and maintain I-9s correctly - between $110 and $1,100 per I-9.
    • Subject to criminal penalties for "pattern and practice violations" in which the employer may face a penalty of $3,000 and/or 6 months in jail.
