Potential Fines, Penalties and Liabilities
Failure to abide by US Citizenship and Immigration Service (USCIS) and Department of Labor (DOL) regulations can result in penalties and liabilities to NC State University. These can include
- Debarment from hiring employees into H-1B positions, if NC State is not in compliance with public access file, which may also result in fines ($1,000 - $35,000 per violation). If the employer has not paid appropriate wages, it may be ordered to pay back pay.
- Civil penalties for each offense of employing unauthorized workers can be between $2,200 and $11,000 for each unauthorized worker
- Subject to "paperwork violations" for failure to fill out and maintain I-9s correctly - between $110 and $1,100 per I-9.
- Subject to criminal penalties for "pattern and practice violations" in which the employer may face a penalty of $3,000 and/or 6 months in jail.
