Checklist of NCSU Grievance Procedure Responsibilities of the Chair of the Faculty

- Grievances are to be filed with the Chair of the Faculty. (Section 3.1)
- “The Chair of the Faculty may waive the sixty-day filing period if there were significant extenuating circumstances preventing the grievant from filing within this timeframe.” (Section 3.2.1)
- Within 5 days of the filing enquire as to whether the parties are willing to engage in mediation. (Section 3.3)
- Refer for mediation or if mediation is not agreed to, or is unsuccessful then select a 3-member grievance committee and a chair of said committee (Section 3.3 and 14.2). The Chair of the Faculty and another elected officer of the faculty senate shall select the names of prospective grievance committee members (Section 14.2). Provide a copy of the grievance petition and give notice of the names of the Grievance Committee and Chair of the Grievance Committee to all parties, the Provost, and the Vice Chancellor and General Counsel. Provide copies of the grievance procedure to the Grievance Committee and the Grievance Committee Chair (Section 3.4 and 14.5).
- Receive petitions from any committee member or party to the grievance to disband the committee or replace committee members who are delaying or obstructing the committee's progress. “The Chair of the Faculty shall have the discretion to make any changes to the committee that are necessary to have it function effectively, including replacement of the committee chair.” (Section 8.2)
- Along with the Chancellor determine if a different committee should be constituted in the event of a breech of confidentiality during the proceedings. (Section 8.8)
- Discharge the committee if the grievance is withdrawn. (Section 8.10)
- Receive a copy of the official report of the committee at the time the report is submitted to the Chancellor. (Section 9.4.1 and 9.4.2)
- Receive notification at the same time notification is given to the Chancellor if respondents and grievant mutually agree to resolution, or if no adjustment in favor of the grievant is found. (Section 9.4.2)
- Receive any reports from the committee that recommend changes that might prevent similar grievances in the future. (Section 9.5)
- Receive Chancellor's preliminary decision if the Chancellor's decision rejects any of the findings and recommendations of the committee. Receive a copy of the Chancellor's final decision. (Section 10)
- Provide an annual report on grievance cases to the Faculty Senate. (Section 13)
- As necessary convene the personnel policy committee of the faculty senate to address any changes to the grievance policy. (Section 13)
- Ensure the panel from which grievance committee members are selected is duly elected and if necessary increase the size of the pool of potential members on a proportional basis. (Section 14.1)
- During the selection of the committee the Chair of the faculty will meet separately with each party regarding the constitution of the committee. The Chair shall decide on all requests for “disqualification with cause.” (Section 14.2.2). The Chair shall ensure that there are no conflicts of interest for members of the grievance committee. (Section 14.2.3)
- Ensure that a sufficient number of persons are trained to effectively chair grievance committees. (Section 14.3.2)
- Select the Chair of the grievance committee ensuring that there is no conflict of interest. (Section 14.4)
