POLICY ON RACIAL HARASSMENT

Racial bias or harassment is a form of race discrimination in violation of Federal law and North Carolina State University policy, and it will not be tolerated. North Carolina State University is committed to assuring equal opportunity and to opposing discrimination because of race, sex, age, religion, national origin, handicap or veteran's status. Faculty, staff, and students should be aware that violation of this policy could lead to disciplinary action.

North Carolina State University hereby affirms its desire to maintain a work environment for all staff and an academic environment for all faculty and students that is fair, humane, and responsive. North Carolina State University wishes to maintain an environment which supports and rewards career and educational goals on the basis of such relevant factors as ability and work performance.

Conduct or action that is based on a person's race or color creates a hostile environment that prevents effective learning or work performance, and it is in opposition to a campus environment free of discrimination.

Prevention of Racial Bias or Harassment

Prevention and education are the best tools for the elimination of racial bias and harassment. North Carolina State University is committed to taking all steps necessary to prevent racial bias and harassment, including offering programs such as the race awareness seminars designed to make individuals aware of the nature of racial bias.

Informal Mediation Procedure

If an employee, student or faculty member believes he/she is a victim of racial bias or harassment, the person may consult the school or unit affirmative action liaison officer or the person may consult the appropriate University-level office as follows:

These offices are available for information and clarification of policy and if necessary will forward a request to mediate a dispute to the Affirmative Action Office. Every effort will be made to remove any misunderstandings concerning appropriate behavior and/or to eliminate harassing behavior if it exists. The role of the school or unit affirmative action liaison officer is to counsel, advise and persuade, not to make judgments or assign penalties. Action may be taken, however, by the supervising administrator. All contacts and complaints will be treated confidentially and impartially. It is helpful if the person prepares a written statement describing the perceived incidents of racial bias or harassment.

If the Affirmative Action Office is unable to mediate a dispute involving perceived racial bias or harassment, the Associate Provost and Affirmative Action Officer will have the authority to request and review written statements from both parties to the dispute, and will forward a written recommendation to the Chancellor for review.

The Chancellor will have the final review of the mediation and will make recommendations to the parties affected as to how the bias or harassment can be eliminated.

Nothing in these informal policies regarding racial harassment will violate a person's rights to pursue other remedies as provided by administrative procedure and state or federal law.
