Revised (1) To more clearly define what constitutes a rule and who has final authority to approve a rule and (2) to simplify the process by which a rule is approved.
Our PRR protocol has been revised a number of times to make the adoption and publication of PRRs more efficient and user friendly, however there remains a lack of clarity as to what a rule is and who has authority to approve a rule. The proposed revisions therefore clarify what constitutes a rule and who has final approval authority. The final authority for approval of rules will be the unit administrator with authority delegated from an executive officer with concurrence of the Vice chancellor and General Counsel. If the executive officer so chooses, the executive officer may retain authority for the subject area in which event the regulatory effort will be a regulation; if the executive officer sub-delegates the subject area to an administrative or academic unit, it will be a Rule. Sub-delegations may be made to units for unit specific matters that affect the operational responsibilities of the unit. The protocol also permits units to approve rules if delegated through a policy or regulation. Unit rules may not be inconsistent with Regulations. These revisions codify our current operating practice with academic PRRs, e.g., there are Academic policies enacted by the BOT, academic regulations issued by the Provost, and academic rules issues by the colleges and departments.
