June 3, 2008 Current Version - The current NC State Regulation requires the University to distribute royalty revenue to inventors before the University recovers its expenses associated with the prosecution, maintenance and defense of the patent.  The proposed revision would permit NC State to recoup the actual (non-reimbursed) costs of patenting and licensing an invention before distribution of revenue obtained from commercializing the invention, which practice would be consistent with the vast majority of public and private research institutions in the United States. The current Regulation does not provide for any share of royalty income to the inventors College or Department.  The proposed revision would require distribution of 5% of net revenue to the College and 5% of net revenue to the Department/Unit.  The inventors share would be 40% of net, rather than the current 40% of gross.  The 10% to College and Department/Unit would decrease the Patent Trust Fund share to 50% from the current 60%.  This revision would recognize the importance of those administrative units in supporting the intellectual property commercialization efforts of the University.
