Procedures for Reconsideration of Expulsion

Administrative
Memorandum #346 from the UNC General Administration permits the reconsideration
of "expulsion" whenever the Chancellor who imposed or approved
the sanction (or his or her successor) concludes on the basis of the former
student's
petition and any supportive documentation that the individual should be given
a new opportunity to pursue higher education. The following procedures govern
the review of expulsions at NC State University.
1. Timing of Petition
After an expulsion has become final, the former student may address a petition
to rescind the expulsion to the Chancellor. A petition to rescind an expulsion
will not be considered prior to the expiration of two years after the student
has been notified of the Chancellor's decision. Repeat petitions will not
be considered until at least one year has passed since the previous petition.
2. Contents of Petition
A petition for rescission of expulsion should list reasons why the former
student deserves to be readmitted to the University. The reasons should focus
primarily on the former student's life after the expulsion and why the student
believes that he or she should be given a new opportunity to pursue higher
education. Re-argument of the merits of the expulsion is inappropriate unless
exonerating evidence has become available that could not have been discovered
at the time of expulsion. Additional information may be sought by the appropriate
administrator reviewing the case as set forth in Section III-C below.
3. Process for Review
The Chancellor will forward the petition for rescission of expulsion to the
Vice Chancellor for Student Affairs in cases of non-academic expulsions and
to the Vice Chancellor for Academic Affairs in cases of academic expulsions
for their review and recommendation. The Director for the Office of Student
Conduct or the appropriate Dean, depending on where the case was initially
heard, shall collect pertinent documents, compile a record for review, and
provide other assistance as needed. Additional information may also be requested
from the student. The information to be collected in each case will vary based
upon the nature of the underlying offense leading to the expulsion and the
contents of the petition submitted by the petitioner. The appropriate Vice
Chancellor may form a committee to interview the petitioner and assist in
evaluating the petition. The Vice Chancellor or committee may seek the assistance
of other University personnel such as the Counseling Center, Substance Abuse
Educator, or Public Safety in obtaining additional information pertinent to
the petition and in evaluating the petition. The compiled record shall be
provided to the student who shall have the opportunity to provide additional
information or commentary to the Vice Chancellor.
The Vice Chancellor shall provide a written assessment of the petition and
a recommendation to the Chancellor along with the record.
The Chancellor will consider the assessment and recommendation, render
a decision and notify the petitioner. The decision whether to readmit a former
student who was expelled shall be entirely in the Chancellor's discretion.
Any student who successfully petitions for expulsion rescission and returns
to the University will be placed on disciplinary probation for the remainder
of his or her academic career at NC State. In addition, a readmission may
be conditioned on any additional requirements the Chancellor imposes. The
transcript of a student who is successful in petitioning for expulsion rescission
will retain the expulsion notation and the phrase "Approved for Reinstatement" will
be added to the transcript.
No institutional appeal is available. The student, however, may re-petition
provided that one year has elapsed from the
time of any previous petition's denial.
