NC State University Response to Sexual Offenses
Possible sanctions for rape, acquaintance rape or other sex offenses (forcible or non-forcible) following an on-campus disciplinary procedure would include any of the following: warning, censure, restitution, service hours, fines, administrative room change, special program, counseling, restriction of privileges, disciplinary probation, disciplinary eviction, suspension and expulsion.
Staff members in the Office of Student Conduct and in University Housing will determine whether the alleged misconduct results in expulsion, suspension or removal from housing. Students subject to those sanctions are afforded a hearing before the Student-Faculty Hearing Board.
Representation by an attorney is not permitted in university disciplinary hearings or conferences. However, respondents referred for a Student-Faculty Board Hearing may be accompanied by an advisor (who may be a student), a student assistant from the Student Judicial Office or a staff or faculty member who is not an attorney. In addition, the following complainant’s rights in cases involving sexual offenses, sexual abuse or rape shall be applicable during this disciplinary process.
Complainants involving sexual assaults have the right to be accompanied by a person(s) of his/her choice; the right not to have his/her irrelevant sexual history discussed during the hearing/ the right to remain present except during deliberation; and the right to be informed immediately of the outcome of the hearing. These rights can be neglected if the claimant forfeits his or her right through inappropriate behavior or forfeits the right to make an impact statement and to comment on penalty if the respondent is found guilty.
UNIVERSITY HOUSING
If a student living on campus is sexually assaulted and, as a result, wishes to receive a new campus housing assignment, he or she is encouraged to contact University Housing for available vacancies and to receive information concerning the room change process.
